A Queue Position No Longer Buys Power

Denmark's Ministry of Climate, Energy and Utilities published an emergency grid law on August 20, 2026, following a broad political agreement reached in late June. The law replaces the country's first-come-first-served queue for new grid connections with a 4-tier priority system, a structural change to how access to electricity capacity gets allocated rather than a temporary patch. Under the old model, an application's place in line determined when a project could connect, regardless of what that project was or how it planned to use the power.

Under the new system, data centers rank in the lowest of the four tiers, placed behind other categories of new demand competing for the same limited grid capacity. Minister Samira Nawa said the grid is under pressure that threatens to bring the country's green transition and broader development to a standstill, framing the reform as a response to genuine physical scarcity rather than a policy preference against any single industry.

Grid-Friendliness Becomes the Admission Test

The mechanism that actually decides who connects and when is not application date but demonstrated grid-friendliness: whether an operator is willing to curtail or flex its demand when the grid operator requests it. A data center that can prove it will scale back consumption during periods of grid stress moves up the practical queue; one that insists on constant, uncurtailed draw does not, regardless of how early it applied or how much capital it is prepared to commit.

That distinction matters because it converts a sustainability feature into a commercial precondition. Demand-response capability - batteries, flexible compute scheduling, on-site generation that can substitute during a curtailment event - stops being something an operator adds later to improve its ESG profile. It becomes the technical requirement that determines whether a Danish grid connection is available at all.

The First EU Jurisdiction to Rank by Category, Not Application Date

What makes Denmark's law distinct within the EU is not that it limits data-center growth - other member states already do that in practice - but that it formalizes data centers as a named, lowest-ranked category inside a national statute, rather than managing them through informal moratoria or discretionary permitting delays. Ireland has operated a de facto connection freeze for new data centers in the Dublin grid area for several years, driven by the same underlying scarcity. The Netherlands has similarly capped new large-load connections in parts of its grid, particularly around Amsterdam.

Both of those measures function as caps or freezes applied case by case. Denmark's approach is different in kind: it writes a permanent, rules-based ranking into law, with a behavioral test attached to it, rather than pausing the queue and waiting for capacity to catch up. That combination - explicit category ranking plus a demand-response admission test - is the part other grid operators under similar pressure are positioned to copy.

What This Changes for a Site-Selection Decision

For several years, the standard advice to any operator planning EU data-center capacity has been to check the grid connection queue and the interconnection timeline, then plan around whatever position that produced. Denmark's law breaks that model. Queue position no longer determines who gets power in Denmark; a demand-side behavior test does, and an operator's answer to that test now sits above capital commitment or application timing in determining outcomes.

The practical instruction for an EU or UK operator evaluating Danish capacity, or capacity in a jurisdiction likely to follow Denmark's example, is to treat demand-response and flexibility capability as the actual admission ticket rather than a later optimization. Ireland and the Netherlands are the two EU grid operators most exposed to the same pressure Denmark cited, and both already run their own versions of data-center restriction - making them the most likely candidates to adopt a similar tiered, behavior-conditioned system next.
