A letter on a Tuesday stopped a gigawatt project

Stephanie Garcia Richard is the elected public lands commissioner of New Mexico, and on Tuesday 14 July she wrote to say no for the second time. The request was for permission to build part of a gas pipeline extension across state trust land near Santa Teresa. She had already refused the same request in March. The pipeline exists to feed Project Jupiter, a hyperscale data centre campus tied to Oracle and OpenAI, sitting on roughly 1,400 acres and designed for more than 2 gigawatts.

Two gigawatts is the scale of a large nuclear station. The campus was going to power itself. That was the whole point of the design, and it is now waiting on a letter from a state office about a strip of land.

Oracle went off-grid to skip a queue, and found another one

Why it matters: the off-grid move was supposed to be the escape hatch, and it turned out to have its own gate. Oracle's first plan was a natural gas power plant on the site. That plan stalled when the state air permit application ran into objections over air pollution and greenhouse gas emissions. In April the company switched the whole campus to Bloom Energy natural gas fuel cells instead.

Fuel cells removed the need for a power plant permit. They did not remove the need for gas. Gas arrives by pipeline, a pipeline crosses land, and some of that land is state trust land administered by an elected commissioner who had already said no once. The constraint was never the grid specifically. The constraint was that a large industrial energy project needs consent from whoever controls the physical path, and there is always someone.

The second permit has a date, and the number is the problem

The air quality permit is still live and still contested. New Mexico's Environment Department has scheduled a public hearing for 9am on 19 October at the Sunland Park Multi-Generational Center, and it scheduled a hearing at all because the opposition was substantial enough to require one.

The figure driving that opposition is in the application. The facility projects 10.1 million tons of greenhouse gas emissions a year. Local reporting puts that above the combined annual emissions of Albuquerque and Las Cruces, the state's two largest cities. That is not a number a hearing quietly waves through, and October is three months of calendar that the campus does not get back.

What the money could not buy

The bottom line: capital was not the binding constraint here, and that is the part worth carrying into your own planning. Oracle's infrastructure spending went from 21.2 billion dollars in fiscal 2025 to 55.7 billion in fiscal 2026, with 90 to 95 billion planned for fiscal 2027. The Information reported on 18 July that Oracle's AI campuses are running into cost surprises measured in billions, with the power supply change a significant part of it.

Money moves fast and consent does not. A budget of 95 billion dollars, roughly 88 billion euros, does not compress a hearing date or reverse a land decision. When we wrote about this campus going off-grid, the honest read at the time was that self-generation routes around the interconnection queue. It does, and this week shows what it routes into.

The question to ask before your next compute commitment

The practical version of this for a European operator is short. When a provider gives you a capacity date, ask which consents are still outstanding, who issues each one, and whether any of them has already been refused. A refusal that has happened once is the single most useful signal available, because it tells you the answer is contested rather than pending.

Europe has more of these gates, not fewer. A site typically needs a grid connection offer, an environmental permit and, if it generates on site, a route for its fuel. Those come from three different authorities on three different clocks. The provider who can name all three and tell you where each stands is describing a real project. The provider who answers with total investment is describing a budget.
