A New Law Ends First-Come, First-Served
Denmark's Ministry of Climate, Energy and Utilities published an emergency law on August 20, 2026, titled Prioritering af kapacitet i elnettet (Prioritization of Grid Capacity), that scraps first-come-first-served grid connections in favor of a four-category priority system placing data centers last.
The four categories rank increased demand from existing customers, new households and small businesses first, followed by projects supporting electrification and the green transition. Battery storage systems, including those built at solar and wind farms, come third, and very large power consumers such as data centers rank fourth, with their position further shaped by how willing they are to flex demand around grid constraints. The political agreement behind the law was reached on June 29, 2026, and a public consultation ran from July 1 to July 28, 2026 before publication.
Energinet Was Already Rationing Before the Law
Denmark's grid operator Energinet had already paused new large-load grid connection agreements starting February 1, 2026, abolishing first-come-first-served for large connections months before the emergency law made that rationing a matter of statute.
The scale of the backlog explains the urgency: roughly 60 gigawatts of proposed projects are waiting in Danish connection queues, against Denmark's own peak electricity demand of only about 7 gigawatts. Some large projects already in the queue face estimated waits of five to ten years for full grid access, regardless of where the new law places them.
A Template for Other Grid-Constrained EU Markets
Denmark has turned an informal rationing practice into a binding legal hierarchy, and that shift matters far beyond its own borders. Grid-constrained markets elsewhere in the EU that have relied on ad hoc delays and tender freezes now have a working legal template for formally deprioritizing large loads like data centers behind households and green-transition projects.
The direction is not universal: reporting on the law notes that the UK's own grid reform has taken the opposite approach, prioritizing data centers to capture AI investment rather than pushing them to the back of the queue. For an EU or UK owner planning a data-center or AI-compute expansion in the Nordics, the practical lesson is to budget grid-connection timelines on the assumption of formal legal deprioritization, not on first-come-first-served.
The Minister's Warning Behind the Law
Minister of Climate, Energy and Utilities Samira Nawa said the reform was necessary because, in her words, our electricity grid is under pressure, and it threatens to bring our green transition and development to a standstill.
The law passed with backing from a broad majority of parties in the Danish Parliament, following a political agreement reached on June 29, 2026, and a four-week public consultation that closed on July 28, 2026. The roughly three-week gap between the end of that consultation and publication reflects how urgently the government wanted the new hierarchy in force.
