A Whistleblower Complaint From the Hottest Week of the Year
On July 17, 2026, Ofgem announced it would oversee an independent investigation into how Britain's National Energy System Operator handled grid operations during a spell of extreme heat from June 22 to 26, when a Met Office red warning covered parts of Great Britain and Europe and pushed the power system toward its limits. The trigger was not the heat itself but what whistleblowers say happened inside NESO's control room while it was under strain: allegations that senior managers instructed staff to avoid creating permanent records of operational decisions and to withhold critical information during the periods of greatest system stress.
Ofgem's own framing of why this matters is unusually direct for a regulator. "Confidence in the operation of Great Britain's electricity system depends not only on the resilience of the system itself, but also on confidence that serious concerns are investigated rigorously and independently," the regulator said in announcing the review. NESO's side of the story is that it has policies in place to prevent exactly this kind of conduct, that it is treating the allegations "extremely seriously," and that no customer lost supply during the heatwave. What NESO has not disputed is the narrower and more damaging claim: that its own staff were told not to keep a paper trail of what they decided and why.
The Watchdog Investigating the Watchdog
The investigation itself is structured to answer the obvious next question: who checks the checker. Ofgem appointed law firm Eversheds Sutherland to run it, under an oversight panel of three people rather than Ofgem alone: Jayne Scott, who chairs NESO's own Audit and Risk Assurance Committee, Siobhan Duffy, a shareholder non-executive director, and Akshay Kaul, an Ofgem director-general. The scope covers interviews with power system managers, control-room personnel and corporate affairs staff, and a review of control-room logs from the heatwave period, which is precisely the kind of record whistleblowers allege staff were told to avoid creating.
No timeline for the findings has been published, which matters more than it might in a routine compliance review: the specific behaviour under investigation is whether records exist at all, so the panel's first job is establishing what evidence survives before it can assess what happened.
Two of NESO's Own Risk Reports Are Already Dark Until 2028
The whistleblower probe did not start this trust problem, it landed on top of one. Ofgem had already suspended NESO's 2026 Annual Frequency Risk and Control Report in March 2026, after delays completing the 2025 edition of the same document, which assesses the risk of serious system frequency events and how NESO plans to manage them. Separately, NESO was excused from publishing its 2026 Ten-Year Electricity Supply Statement, the document that identifies where future generation and demand connections are likely to land on the network. Ofgem's own position is that replacement strategic planning documents will take over from both, but not before late 2028.
Read on its own in March, a delayed annual report is a process story. Read alongside a July whistleblower investigation into whether the same organisation's control room avoided keeping records under stress, it reads differently: for close to two years, the two documents Britain has relied on to see supply risk and connection risk coming will not exist in their normal form, from an operator currently being investigated for how it handles exactly that kind of information internally.
What This Means for Anyone Relying on NESO's Numbers
Ofgem's response to the trust question has been to force more data out of the system, not less. Two weeks after launching the whistleblower investigation, the regulator approved Grid Code modification GC0139, effective from August 6, 2026, which replaces NESO's old annual-only planning submissions with a routine, structured two-way exchange of power system models between NESO and every UK network operator. A rule forcing more frequent, more granular information sharing only makes sense if the previous, less frequent flow is no longer considered sufficient on its own -- which is precisely what a suspended annual risk report and a whistleblower investigation into record-keeping would suggest.
For any company with UK grid exposure through a connection agreement, an industrial power-purchase agreement, or a data-centre siting decision that assumed NESO's annual risk statements would be available on schedule, the practical adjustment is to stop treating those NESO-level publications as available at all through 2028, and to request the underlying network-level data directly from Ofgem or the relevant distribution network operator instead. That is a different, and in some ways more manageable, risk than the capacity shortfalls already priced into UK connection queues: it is a visibility gap at the one organisation everyone else's planning was built to lean on.
